In many voting systems, voters’ preferences on a set of candidates are represented by linear orderings. In this context, scoring rules are well-known procedures to aggregate the preferences of the voters. In order to identify the best scoring rule to use in each situation, we need to know which properties are met by each of these procedures. Although some properties have been analyzed extensively, there are other properties that have not been studied for all scoring rules. In this paper, we consider two desirable social choice properties, the Pareto-optimality and the immunity to the absolute loser paradox, and establish characterizations of the scoring rules that satisfy each of these specific axioms. Moreover, we also provide a proof of a result given by Saari and Barney, where the scoring rules meeting reversal symmetry are characterized. From the results of characterization, we establish some relationships among these properties. Finally, we give a characterization of the scoring rules satisfying the three properties. (shrink)

A country‘s development is bound to be influenced by external occurrences. This article analyses two astronomical examples in which Portuguese nationals used high visibility events in the international scientific community to press their own scientific interests upon the government, whether these interests were, or were not, directly linked to the events themselves.During the 1840s and 1850s the parallax, i.e. the distance, of Groombridge’s star 1830 was hotly debated. The astronomer Hervé Faye‘s suggestion at the Académie des Sciences de Paris that (...) observations be made in Lisbon due to its privileged location and the inadequacy of the Lisbon Navy Observatory to perform them rekindled the efforts to improve the Portuguese Navy observatory.In the 1850s and 1860s other Portuguese higher education institutions also wanted to upgrade their facilities or build new ones. Following accepted traditions, scientific field trips were considered a useful part of the acquisition planning for larger instruments, and therefore an important part of regeneration and renewal projects. The Portuguese scientists were, however, limited in their travels by government imposed budget constraints. The total solar eclipse of 18 July 1860 provided an extra argument to send Portuguese scientists abroad. The government support of the eclipse expedition led to an opportunity to travel through other countries and view their observatories and equipment.In the end, neither the Navy astronomers nor those from the Coimbra Astronomical observatory, the other significant site of Portuguese astronomical research, managed to fulfil their objectives, but the contacts initiated by some of the Portuguese travellers were important for the development of the Portuguese national Meteorological and Magnetic Observatories. The concept of “self-realization” plays a central role in philosophy, since it summarizes the idea that a good life is a flourishing life, that is, an existence in which a person makes the best of what she is. A long tradition has understood this in terms of actualizing one’s potential or fulfilling one’s highest and most worthy aspirations. This article aims to highlight the theoretical and philosophical debate on hospitality underlining the normative elements of framing migrants and refugees as individual agents in the light of hospitality theory and migration governance. It argued the critiques of the neo-Kantian hospitality approach and the EU welcome culture with regard to refugees in the EU from a philosophical perspective. The “No human being is illegal” motto is proposed to be conceived as a principle of the EU Charter of Fundamental Rights. The (...) cosmopolitan right to visit and the universal right to reside were discussed in the context of human rights and co-responsibility. Linking the hospitality approach with migration governance enables the reconstruction of reception policies and practices, diversification of non-state actors that engage in migration governance mechanism, and polarization of political initiatives (e.g., politics of allocation and dispersal, readmission negotiations, convergence/divergence of priorities and strategic interests). The research findings highlight that the EU adopted a neo-Kantian hospitality approach that combines both “co-responsibility” and “vertical/heterarchical relations.” The EU’s “New Pact on Migration and Asylum” was considered proof of how the EU follows neo-Kantian hospitality that is manifested in dualism and contradictory approach. The study presents a typology that splits co-responsibility into individual/institutional actions and human rights/migration governance. (shrink)

In the evolution of criminally relevant action in modern crime theory, social action has assumed a particular significance as a dogmatic element that enables the effective protection of legal assets in a society beset by risks. In the vast array of theories regarding the role of the guarantor and its legal and doctrinal development, as well as the jurisprudential extension of equivalence clauses of improper omissions that serve as amplifier devices of the criminal statue through an indirect adaptation, there is (...) a need to identify the most effective means to shield legal assets, which allows for an imputation of passive conducts, despite having an active typical description. This introduces the controversial figure of the improper omission, which is used with the function of perfecting all of the structural elements of the criminal conduct. When an individual knows he is in a position of guarantor and is aware of the potential consequences, but fails to take action, having the means to prevent a foreseeable outcome, this device serves to enhance the criminal protection of legal assets, fostering social solidarity as the basis of the criminal justice system. This system, by satisfying the function of general prevention of the punishment, ideally dissuades the individual from committing crimes with the threat of penalty. These theories are fundamental to understanding criminal responsibility by improper omission in the context of the objective imputation theory. By guiding the evolution and delimitation of its application, they serve as a significant factor in criminal social control in Colombia. (shrink)

Contracts play an important role in business management where relationships among different parties are dictated by legal rules. Electronic contracts have emerged mostly due to technological advances and electronic trading between companies and customers. New challenges have then arisen to guarantee reliability among the stakeholders in electronic negotiations. In this scenario, automatic verification of electronic contracts appeared as an imperative support, specially the conflict detection task of multi-party contracts. The problem of checking contracts has been largely addressed in the literature, (...) but there are few, if any, methods and practical tools that can deal with multi-party contracts using a contract language with deontic and dynamic aspects as well as relativizations, over the same formalism. In this work we present an automatic checker for finding conflicts on multi-party contracts modeled by an extended contract language with deontic operators and relativizations. Moreover a well-known case study of sales contract is modeled and automatically verified by our tool. Further, we performed practical experiments in order to evaluate the efficiency of our method and the practical tool. (shrink)

We study envy-free allocations in a many-to-many matching model with contracts in which agents on one side of the market (doctors) are endowed with substitutable choice functions and agents on the other side of the market (hospitals) are endowed with responsive preferences. Envy-freeness is a weakening of stability that allows blocking contracts involving a hospital with a vacant position and a doctor that does not envy any of the doctors that the hospital currently employs. We show that the set of (...) envy-free allocations has a lattice structure. Furthermore, we define a Tarski operator on this lattice and use it to model a vacancy chain dynamic process by which, starting from any envy-free allocation, a stable one is reached. (shrink)

Este artículo analiza la relación entre dos autores, Lord Acton y Balmes, en lo que entendemos que ha sido la gran cuestión de la política moderna: la nación y el problema del nacionalismo. Se citan los textos estrechamente relacionados con el tema y se han descartado aquellos más generales o, en el caso de Balmes, de carácter más dogmático o teológico. En el caso del autor español se han seleccionado sus escritos políticos aparecidos en los diferentes medios de prensa en (...) los que colaboró a lo largo de su prolífica carrera. Ambos autores trataron de superar por elevación la dialéctica absolutismo-liberalismo, y propusieron, cada uno a su manera, un modelo de Monarquía Constitucional que no cediese ni al nacionalismo, ni al autoritarismo. Asumieron como propias ideas renovadoras acerca de la libertad política, adaptaron a sus circunstancias las formas políticas propias del federalismo estadounidense, y defendieron la tradición, la religión y el Estado frente a los que ellos entendían que eran las dos grandes amenazas de su época que crecían al amparo del nacionalismo: el individualismo racionalista y el autoritarismo estatalista. The politicization of Islam from a European viewpoint is apparent in how the Islamic ‘veil’ has become an icon of Islam’s alleged deficits with regard to fitting into European modernity. This article unpacks the iconic symbolism of ‘political Islam’ and shifts the focus to Muslim voices articulating struggles for justice and solidarity through the attempt to reformulate secular republicanism and critique its authority basis. This is the emerging trend of ‘critical Islam’, which targets both the hegemonic discourse on secularity and (...) republicanism, and its antithesis, that is, ‘communitarianism’, understood, in European-continental parlance, as the ideology that perpetuates traditional forms of authority. In this context, the article examines the work of the French commission on laïcité and the debates it initiated within the emerging Euro-Islamic public sphere. The analysis puts in evidence the critical potential of this public sphere to enrich the categories of the European sociology of religion. The critique of the normative limits of secularity is thus linked to the valorization of the transnational positioning of critical Islamic voices in Europe. Their capacity to penetrate the political process, related to the erosion of the nation-state and to the conflicted reconstruction of a pan-European republicanism, is a precious asset. (shrink)

This article draws on Gloria Anzaldúa's philosophy to analyze Latina/o cultural forms as responses to the lawful violence that renders migrants and other minoritarian peoples as disposable subjects. The article turns to Latina/o playwrights and undocumented poets whose art forms, produced under the deportation regime, express a desire for freedom from terrorizing governance. Focusing on Lydia, a play by Mexican American playwright Octavio Solis, and poetry by an undocumented artist, Yosimar Reyes, it links these representations of “illegal” migrants to understand (...) how minoritarian aesthetic practices respond to racial terror and lawful violence. It argues that if we are to map the present beyond terrorizing forms of law, we must center our philosophical thought on “illegal” imaginaries of freedom, not on the cultural forms sanctioned by legality—the latter risk reproducing the logic of state-sponsored violence, whereas the former enact freedom as a practice of everyday life.
